                                                      Agreement for Water Well 

  

This is an Agreement between Haiti Mission, Inc. (“Haiti Mission”) and ____________X_______________ (“ X “)  in which Haiti Mission agrees to drill a water well for X, and X agrees to pay money for such service, all of which shall be performed in accordance with the terms and conditions below.

 One:  Well Fee – The fee shall be $10,000.00 US for a single well with a six inch bore hole, down to any depth up to, but not to exceed, 200 feet.  A retainer in the amount of $5,000.00 US shall be paid by X to Haiti Mission in advance and prior to equipment being moved to site, with the final $5,000.00 due once equipment is placed at the site, but prior to drilling.  If satisfactory water is not located before a depth of 200 feet is reached, additional drilling will be performed if both parties agree, and shall be done at the cost to X of $10.00 US per foot down to the maximum depth of 500 feet.  No guarantee is made by Haiti Mission that water will be found, and payment is required whether or not water is located. 

Two:  Pump Cost - A manual pump will cost approximately $5,000.00 US.  This or any other pump cost is in addition to the $10,000.00 US fee for the well, as stated above.  Other types of pumps may cost different amounts depending on many factors, including depth of well, type of pump, and materials required. The fee for a manual pump is only stated as an estimate however, and is not part of this contract.  If the Haiti Mission agrees to install a pump, the terms and conditions of such installation will be determined at that time.

  

Three:  Inability to Reach Site - If for any reason Haiti Mission is unable to get the equipment to the location requested, they shall notify X as soon as practical, and shall return any deposit made, less reasonable expenses incurred by them.

 

Four:  Obligations of X:  X is responsible for the security of the equipment while on site.  The retainer fee includes a security deposit.  Any damage or vandalism inflicted on the equipment, other than by an act of God, will be assessed and added to the contract amount.  X is also responsible to feed and house in a reasonable way the drilling crew as well as furnish sufficient water for drinking and drilling while drill project is in process.

Letter of commitment and intent when well is drilled for public or community use.

 

For community use, a signed letter of commitment and intent must be exercised prior to drilling which describes the following: 1.    Donation or purchase of the necessary property (usually about 20' x 20') for community use of the well.2.    A committee to oversee the well and raise necessary funds to buy the cement, buy the pump and completion material, supply the necessary drilling water, gravel, sand and house and feed the crew while on site.3.    This committee or an additional committee will be responsible for security of the well and funding all future necessary maintenance and repair of the pumping equipment.                                  

 

 HUMANITARIAN AID and NON-PROFIT RELEASE AGREEMENT

 

This is a Release Agreement between Haiti Mission, Inc. and (your organization Name or individual contracting party) (your organization address) (your organization phone number) Please Initial Each Item Below:

 

1.    Haiti Mission, Inc. will do its very best to follow through on the delivery of the contracted agreement and services; however it is agreed that we will not be held liable in the event that unforeseen circumstances arise that make delivery or completion of contract impossible.  Refund of any retainer is as per contract agreement. ____

 

2.    Your organization is responsible for any shipping or customs duties or costs incurred for completion equipment or supplies that you may need shipped in.  ______

 

3.    Haiti Mission, Inc. will not be liable for loss or damage to completion equipment or supplies.  Security for the equipment and supplies is expressly the responsibility of the contracting above mentioned organization. ______
